Good Character Requirement for UK

For every visa application, and especially to apply to become a British National, into the United Kingdom there is much about yourself which is considered by the UK Immigration Authorities before your application is approved or denied. A criteria which many people are unsure of the exact requirements are is the ‘Good Character’ - this is a vital part of the Immigration Authorities decision making and so you should understand fully what the heading means. Those who are considered not of good character will not be accepted into the United Kingdom under any visa. 

There is a very minute number of exceptions where people in certain circumstances will be exempt from the Good Character investigation process and these are: 
  • For all minors aged under ten years old
  • You are a British protected person / overseas British citizen 
In order for the assessment of Good Character to be carried out we will take your signature on your visa application as your consent to obtain any information about you. This is fully explained under all the terms and conditions of each visa. 

Initially we will contact the Police in the UK and your native homeland to receive a police clearance check (there is a fee for this which is not waivable and must be paid for by yourself). This applies to all persons over the age of ten and we look into everything from serious violent crimes to traffic offenses or non payments of fines, even fixed penalty notices are taken into account. Regarding convictions and crimes which have led to issues with the law in the way of sentences there is a lot of red tape here and this won’t always mean that you will not be approved.

A non custodial sentence (one where you were not imprisoned) will not lead to you being refused if this occurred more than three years ago. If you have received a custodial sentence (one where you were incarcerated) for up to 12 months then if this was not within the last seven years you could still be approved. Custodial sentences up to four years will mean you will be denied entry unless this was more than 15 years previous. Any custodial sentences which were four years or longer will absolutely see your application denied, there are no exceptions here. Your financial history will be thoroughly investigated by the authorities and this means that we will check with Revenue and Customs that you do pay tax and national insurance contributions. If you have ever declared yourself, or indeed been declared bankrupt then it is more than likely you will not be approved entry into the United Kingdom.
