USCIS to Implement Employment Authorization for H4 Dependents by Suspending H-1B Extension Petition

Extension of Stay H-1B petitions temporarily by USCIS
The United States Citizenship and Immigration Services (USCIS) will suspend the premium processing temporarily for all the H-1B extension of stay petitions from 26 May 2015 to 27 July 2015. 

At this time, petitioners cannot file Form I-907, as well as Form I-129, for an extension of the stay on H-1B visa

The suspension temporarily allows USCIS to implement Employment Authorization for Certain H-4 Spouses and determined applications for the employment authorization filed by non-immigrants of H-4 under the new regulations.  

Before 2015 May 26, USCIS will continue to premium process H-1B extension of stay applications filed with Form I-907. 

The Processing fee will be refunded by USCIS:

If H-1B petitions are filed by a petitioner before 26 May 2015 using processing service, USCIS has not taken decision within the time of 15-calender-day period on the case.  

Premium processing is available for all other Form I-129 H-1B petitions, considering the petitions which are subject to the H-1B cap requesting a change of consular notification and nonimmigrant status.
