USCIS Finishes Random Selection Procedure on H-1B Visa Cap for FY 2016

USCIS successfully accomplishes H-1B visas
As per an announcement made by U.S Citizenship and Immigration Services (USCIS) on 7 April, 2015, it has obtained enough H-1B visa requests to reach the lawful limit of 65,000 visas for the fiscal year (FY), 2016. The USCIS has even accepted more than the cap of 20,000 petitions of H-1B visas, and it put them in place under the exemption of advanced degree. They also refer it as master’s cap. 

During the filing period, USCIS got almost 233,000 H-1B requests, starting 1 April, it includes petitions filed under the advanced degree exemption. On 13 April, USCIS made use of a computer-generated random selection process or lottery system to select enough requests to meet the requirement of 65,000 general group caps and the limit of 20,000 for the advanced degree exemption. The USCIS will dismiss and send back all unselected requests along with their fees paid at the time of filing, in case the petition filed twice.

The agency carried out the selection process first for the advanced degree exemption. The Petitions which are not selected later on became a portion of the random selection process for the 65,000 limit. As promulgated on 12 March, 2015, the agency will begin to process the premium H-1B visa cap incidences before 11 May, 2015.

The agency, USCIS will carry out its task of receiving and processing petitions, which otherwise is exempt from the limit. Requests filed in favor of present H-1B workers who have been estimated earlier against the limit will also not be included in the mandatory H-1B visa limit for the FY 2016. Apart from this, the agency will keep on moving forward to process petitions that are filed to the following:
  • Prolong the time a present H-1B worker is remaining in the U.S;
  • Alter the terms of job for those employees currently working under H-1B;
  • Permit H-1B employees to change their employers in the U.S.; and 
  • Allow those who are working as H-1B holders to work together in a second H-1B position as well

U.S jobs utilize the H-1B program to hire overseas workers in jobs that need highly specialized knowledge in areas like engineering, science and computer programming.
