USCIS Attains H-2B Visa Target for the first half of the FY 2018

USCIS has made an announcement that it has attained the H-2B target for the Fiscal Year 2018.

Dec. 15th, 2017, marked the last date of receipt for new H-2B worker applications to request for an employment commencing before April 1, 2018. USCIS will now be entitled to reject all new applications which are received after Dec. 15th seeking an employment before April 1st, 2018. It will still accept applications which are exempted from the cap mandated by the Congress. 

The statement spoke of the categories included like the present H-2B workers in the country seeking extension of their stay, changing the conditions of employment, changing their employers; as well as Fish roe technicians/processors, supervisors in charge of fish roe processing; and Workmen doing labour tasks and services in Guam and North Mariana Islands (from November, 2009, -December, 2019).

Besides these it proposes to accept the cap- related applications for the next half of the Fiscal Year 2018 meant for jobs commencing after April 1st, 2018. The limit for the program is placed at 66,000 for each year. Among these, 33,000 are allotted to workmen, to commence their employment, during the opening half of the year, starting from October 1st to March 31st, and 33,000 are allotted for workers intending to start their work in the next half of the year from April 1st to September 30th.

The US administration spoke about the need for additional non-agricultural foreign workers in July 2017. There was an announcement of increasing the numbers, to 15,000 extra visas. This also meant that Spouse of an H-2B worker as also unmarried children below 21 years of age can come with the applicant on the H-4 visa but they do not have the eligibility to do any jobs in the country. The H-2B recipient can continue to stay in the US, for three years, and must leave it and remain out of USA for 3 months prior to making a plea to be readmitted a non-immigrant in the H-2B category.
