US H1-B Visa
For plenty of Indian techies with an H-1B visa who are working in the US, getting a Green Card for PR status could soon be more comfortable as the US House of Representatives has moved by a bill to eliminate a 7% country-cap on candidates. Plenty of the 300,000 Indian H1-B temporary work visa holders in the USA are in different levels in the process of obtaining Green Card.

Important Points About US Green Card

  • Presently, there is a 7 percent cap on the maximum number of individuals that can be given US Green Card during a year. Yearly, 26,000 Green Cards are announced by the government of the US.
  • The Justice for Highly Skilled Immigrants Act of 2019, attempts to cancel the cap and provide up to 85 percent of the green cards to be granted to Indians and Chinese in the initial two years and 90 percent in the third year to clear the backlog.
  • This quota affects tech professionals from India and other highly qualified individuals, residing in the US on H1-B work visas, pointing to a wait of as long as 10 years. Some of the current studies have told the waiting period for IT professionals from India on H-1B visas is higher than 70 years.
  • The bill was moved by the US House of Representatives on 10 Jul 2019 by an amazing 365-65 votes in a 435-member House.
  • To become law, the bill has to be moved by the Senate also where the Republican ruling Party has a majority. Next it has be signed by President of the US Donald Trump to become a law.
  • India has protested about the intensified scrutiny and higher rates of rejection of H1-B appeals for Indians.
  • A similar bill is recommended by a senator's bipartisan group, including Kamala Harris, Indian-origin Senator is slated to come up for attention soon in the Senate.
