UK Home Office Announces Record Keeping Guidelines for Sponsoring Firms
The UK Home Office has published the latest record-keeping guidelines for UK Tier 2 and Tier 5 visa sponsoring companies. As per the latest guidelines, UK Tier 5 visa and Tier 2 visa sponsors need to keep proof of showing the entry date of any migrant into the UK that they sponsor, in addition to the fundamental right to work checks.

The guidance says that sponsors need to generate a record of when a migrant enter into the UK, in 30 days of the validity period of Visa. Before this change, companies were not required to hold the UK entry date proof. Below the current guidelines, companies will still be expected to have a record of the right to work documentation of the person they sponsored.

New Guidelines Influence on Tier 2 and Tier 5 Visa Sponsoring Companies

When recruiting a Tier 2 or Tier 5 employee, before their employment start date, companies have two choices for getting proof of when a person entered Britain. The two choices depend on whether an individual was viewed by an immigration officer of the UK or whether they crossed by an e-Gate on their arrival.

In-case if a Tier 2 or Tier 5 employee was viewed by an immigration officer of the UK, companies must now check and get a photocopy of the entry stamp in the passport of that person, to comply with the latest guidelines of UK Home Office.

Nationals of Canada, Australia, New Zealand, Japan, South Korea, Singapore, and the USA have been authorized to use e-Gates upon landing in the UK, since May 20, 2019.

Tier 2 or Tier 5 employees moving by an e-Gate will not have had their passport stamped or checked by an immigration officer of the UK, proving their entry date.
