The timeline for filing H-1B visa petitions is approaching fast for the employers who are planning to sponsor their employees for H-1B visa for the next fiscal year 1 October 2015 to 30 September 2016. Starting 1 April 2015, USCIS (U.S. Citizenship & Immigration Services) would commence accepting H-1B visa petitions.

Presumably all the available H-1B visas for the fiscal year is expected to be claimed in the first week of filing and employers are robustly encouraged to apply for H-1B visas before the deadline in order to obtain H-1B visas for the forthcoming year. This concern is particularly for the present F-1 student visa holders and employees who have never obtained H-1B status

Sources said that USCIS issues 65,000 new H-1B visas for each fiscal year; however, sponsored employees must hold at least bachelor degree in the specialty sector. An extra 20,000 new H-1B visas are made available for workers who hold master’s degrees in US universities or educational institutions. 

From past many years, USCIS would almost certainly get more H-1B visa petitions than the available slots, during the initial few days of filing window, activating a random selection process to decide that petitions will be received for processing. To acquire new H-1B visa for worker, employers are encouraged to file applications by 1 April 2015.

For individuals who are unaware of H-1B visa program, USCIS issues H-1B visa status in three-year increments, for a period up to six years, to the eligible overseas employees. The H-1B worker is certified to work only for the particular employer who filed the H-1B visa petition.

Employers should offer an income that fulfills the existing wage for the particular position in the precise geographic area, meet certain obligatory notice requirements and obey all state, federal and native job and office security laws.
