Relief to US H-1B Spouses as Proposed Ban on Work Permit Deferred to 2020
It will be a significant relief to Indians who are working in the US as the recommended prohibition on the US H4 EAD (employment authorization document) is unlikely to go by this year. The recommended rule of preventing spouses of H-1B work visa holders from working in the USA is not likely to finalize prior to 2020 according to a memorandum from the US Justice Department.

US Government Statement On H4 EAD

It was in reply to an ongoing problem in the US Court of Appeals in Washington, DC. The US H4 EAD was launched in the year 2015 by President Barack Obama, which allows dependents of individuals who are in the USA on an H-1B work visa to work in the USA.

The US Homeland Security Department had first recommended doing on with this as soon as in the year 2017, but there have been many obstacles since. Beginning this year, it was assumed that the law might come up for announcement in a few months, even though it is still under a federal review.

Indians, particularly Indian women who are in the USA would be the first group of individulas affected by this process if it goes through. Since the US H-4 work employment authorization method was launched in 2015, Indians, principally female engineers have been the most significant beneficiaries, receiving above 90 percent of the 1.2 lakh visas announced.

This is a portion of President Trump’s Buy American and Hire American drive, which has also occurred in a greater rate of H-1B visa refusals in current years. A study attended by the South Asian American Policy and Research Institute cautioned that the strength of US firms to bring and maintain highly skilled workers would be affected if the nation revokes the H4 EAD visa.
