Recent News on H-1B Leads to Increased Searches on Canadian Immigration in the U.S

Accounts of President Trump, considering tough rules, about extending H-1B visa, has led to an enhanced rise in online searches. The terms like “H1B Canada” are popular now.

Canada might benefit because of tough H-1B rules, which affect highly skilled overseas workforce in disciplines requiring specialization like medicine and healthcare, science, biotechnology, and education. There is a surge in Google searches starting off in the U.S. through the use of terms on topics like “H1B Canada” and “H1B Canadian” with the start of the New Year. He was considering acting on changes which are proposed by the Homeland Security Department. This would lead to cap extensions for H-1 B Holders, forcing out overseas workers, who are waiting for a Green Card before any decision is taken. 

Search queries using “H1B Canada”

News media in India has estimated that the proposed rules will force, 500,000 -750,000 Indian H-1B applicants, to leave the USA, if President Trump gives an approval to the new rules.

In the past also the President has acted against H-1B visa extensions, by issuing an Executive Order in April 2017 calling for reviewing the H-1B program and had frozen a speeded up option for employers, who were looking to a faster employee application process.

There is a Criticism of H-1B, which was supposed to be a temporary non-immigration program, had now become a backdoor pathway to seek permanent residence.

President Trump had a campaign aim to defend jobs and create much more for American workers. He has criticized H-1B and sees it as a preferred way for protecting overseas workers at the cost of Americans.

On the opposite side, he has spoken in favor of H-1B and had said that keeping overseas brain power in the country was essential.

A boon for Canada

The highly skilled foreign labor affected by H-1B modifications is a boon for the federal and provincial governments of Canada, which have customized the immigration programs in the past one or two years to make the entry of these professionals into Canada easy.

A major change in this direction has been the introduction of Global Skills Strategy and its Global Talent Stream of Canada. It reduces the processing time to two weeks of temporary work permit applications for some skilled workers.

Such policies highlight the inclusivity and diversity aspects of the government of Canada as a counter to the immigration policies pursued by President Trump.

Indians have seen success through the immigration system of Canada, and are placed on the top of the list for being invited to apply through the Express Entry system as well as the Provincial Nominee Program of Ontario.

Canadian permanent residence

Applicants for H-1B visa looking towards Canada have many options to obtain Canadian PR status, which can be renewed after five years and permits its holders to live and work in any part of the country.

Express Entry, the economic immigration system of the Federal Government, helps the candidates to enter by using any of the three classes — the Federal Skilled Worker Class, the Federal Skilled Trades Class, and the Canadian Experience Class.

In it all eligible candidates are given a rank based on the scores given for their human capital factors, like age, education received, language proficiency mastered and work experience gained. Moreover, having a job offer is not essential to be a candidate in the pool of Express Entry.

H-1B applicants possessing advanced proficiency in English, and who have received top quality education and gained a skill set with sufficient work experience have an advantage in the Express Entry.

They are eligible to gain an entry in the Express Entry pool through the Federal Skilled Worker Class. If the results of Express Entry draws held in 2017 are reviewed, their CRS score of 441 would have been sufficient to obtain an invitation to apply for permanent residence in Canada through Express Entry in a majority of the 30 draws held in 2017.

In 2018, Canada aims to have a high invitation target in the three Express Entry categories which would facilitate large draws from the pool of candidates. In that scenario, the CRS cut-off scores will drop considerably as the year progressed.

Provincial nomination

Canada allots an immigration quota, to its provinces and territories each year by using the Provincial Nominee Programs, which permit them to nominate overseas workers to gain permanent residence in Canada depending upon local labour requirements.

Several provinces manage enhanced PNP streams which are aligned with the Express Entry system. Express Entry candidates possessing a Provincial Nomination receive 600 more points in their CRS score.

Work Permits

A temporary work permit is yet another option to enter Canada. Around 300,000 overseas workers use it every year. The country offers several options for work permits for temporary foreign workers.
