Quebec Judge Orders Province To Process Pending 18,000 QSWP Applications

Superior Court judge of Quebec has ordered the Quebec government to resume processing a backlog of approximately 18,000 pending appeals to the popular   Program of Quebec Skilled Worker that the CAQ government plans to cancel. 

The ruling by Justice Frédéric Bachand gave a 10-day temporary directive in reply to discussions by a group of immigration lawyers’ that the proposal to remove the backlog was absolutely illegal and would have destructive outcomes for concerned applicants.

Quebec Government Introduced Bill 9

The present Quebec government introduced ending all backlog applications submitted for Quebec Skilled Worker Program before Aug 2, 2018, in legislation tabled Feb 7.

The law, known as Bill 9, told the order of termination was to take force immediately. The Government of Quebec must grant a CSQ prior to a Quebec Skilled Worker Program (Q.S.W.P) applicant can appeal for Canadian PR.

The CAQ government’s plan has been broadly criticized as unethical given the time length that several applicants have been anticipating for a conclusion on their file and the truth is that many of them are already working and living or studying in the Quebec province as temporary residents.

The government states concerned applicants will alternately have to generate a profile utilizing the province’s current online Expression of Interest system, which was launched last August to control the candidates' pool for the Q.S.W.P.

The appeals that the CAQ government wants to stop were presented when the Q.S.W.P received paper-based appeals on the basis of first come, first served.

When the suggested legislation was proposed, Simon Jolin-Barrette, Quebec Immigration Minister, told the system of Expression of Interest is an excellent fit for the C.A.Q government’s attempts to tailor the skilled workers' selection to labor deficits in regions throughout the province.

When the Bill 9 was started, Jolin-Barrette told refusing the application backlog was essential so the Quebec government could concentrate on selecting applicants in the pool of Expression of Interest and lessen the processing times from 36 months to 06 months.
