Act No. 82/2005 on Illegal Work and Employment, has a list of all Illegal employment practices. These include immigration violations for example, hiring overseas nationals to do work without issuing a proper employment contract, delay in notifying the start of employment, employing nationals from non-EU areas without proper permit, and violations in social security and tax matters.
Applicability to EU ICT applications
Employers who sponsor overseas workers under an EU ICT Permit face work authorization rejection in case the employer violates the law regarding using illegal employment practices during the last five years.
Note for employers
All employers need to keep the records regarding the case. Employers must also check with authorities whether the records of illegal employment in the relevant period can be wiped out. This will help them to avoid any rejection of applications in the future.
