Employer Duties for Protecting TFWs & Canadians Against Coronavirus
Employers in Canada are authorized to bring temporary immigrant workers into the nation, but they should do their part to assure the protection of the new arrivals and also residents in Canada.

It is now compulsory for all travelers to Canada to undergo 14 days self-isolation period. They can't even stand at the grocery store on their way from the international airport to their home. Companies are required to promote this measure while supporting the health and wellbeing of immigrant workers, particularly if they are giving housing facilities.

The government of Canada has compiled several criteria for companies to follow in agreement with regulations of quarantine. There are other supplementary criteria for companies that provide housing facilities for their workers.

Requirements for Employers

  • Companies must comply with all regulations and policies concerning the employer-employee connection during the self-isolation period, provided that the worker’s employment period is supposed to start upon their entry to Canada.
  • Companies must give international workers their regular pay and privileges during workers' self-isolation period. For workers in the Program of Seasonal Agricultural Worker, the terms of the applicable agreement need to be followed. Other workers need to be paid for a minimum of 30 hrs per week at the rate of payment stipulated on the Labour Market Impact Assessment (LMIA). Companies may withhold official contract deductions like Employment Insurance, according to the appropriate immigration program criteria.
  • Companies cannot entitle workers to work through the self-isolation period even if asked by the worker. Exemptions apply to workers who have been considered to be contributing a vital service by the Chief Public Health Officer.
  • Companies must regularly observe the workers' health who are self-isolating, also observe if any employee who becomes sick following the self-isolation period.
  • Employers need to provide for symptomatic workers to be completely and quickly isolated from others and reach local health officials. Companies should also reach the relevant consulate.
  • Employers need to assure that all workers have access to individual hygiene. They should give the soap and also an alcohol-based sanitizer if those are not available.
  • Companies should provide details to the worker on COVID-19 either on or prior to their starting day of self-isolation. 
  • Companies, and all residents in Canada, should report Quarantine Act violations to regional law enforcement. This comprises workers that do not consider the necessary self-isolation period.
  • All individuals in Canada are required to follow the recent public health terms, including directions from the governments of both federal and provincial where they work. Companies are also expected to follow all applicable federal and provincial laws of employment and health safety.
