Changes to Skilled Occupations Lists likely in mid 2018

The Department of Jobs and Small Business published a draft bulletin. It invites comments from the public on the projected changes in the skilled occupations lists to be effective from mid 2018.

It is using the Traffic Light system and some occupations face removal from the skilled occupations lists. Yet some others face movement among the Short Term Skilled Occupations List, Medium to Long Term Strategic Skilled List and also the Regional Occupations List.

Here we explain the occupations which are under consideration for removal. It also has those in transition between the lists, and their likely impact on future.

Application affected


The proposed changes are likely to affect employer sponsored applications and General Skilled Migration category.

Occupations facing Removal


These occupations appearing on the STSOL are facing removal from the list completely:

• 133411 Manufacturer
• 211499 Visual Arts and Crafts Professionals nec
• 212312 Director (Film, Television, Radio or Stage)
• 212314 Film and Video Editor
• 212315 Program Director (Television or Radio)
• 212316 Stage Manager
• 212317 Technical Director
• 212318 Video Producer
• 241311 Middle School Teacher
• 323215 Textile, Clothing and Footwear Mechanic
• 323316 Watch and Clock Maker and Repairer
• 342411 Cabler (Data and Telecommunications)
• 342413 Telecommunications Lines worker
• 399211 Chemical Plant Operator
• 399312 Library Technician
• 411715 Residential Care Officer
• 599612 Insurance Loss Adjuster

Occupations to be Moved


These occupations are presently on the MLTSSL and are likely to move to the STSOL:

• 221112 Management Accountant
• 234111 Agricultural Consultant
• 312212 Civil Engineering Technician

These occupations are presently on the STSOL and are likely to move to the MLTSSL:

• 452411 Footballer

These occupations are presently on the STSOL and are likely to move to the ROL. These require the position to exist in a regional area of the country:

• 252312 Dentist
• 253211 Anaesthetist

Impact on ENS Direct Entry Applicants


In case a candidate is looking for the ENS Direct Entry application, and the occupation faces removal from the MLTSSL, he/she will not be eligible if the application is sent after the changes take effect.

If the application is forwarded before the changes take effect, it is likely to be processed in case the occupation is removed in the time when the application remains pending.

Impact on 482-TSS Applicants


In case the occupation is removed entirely from the skilled occupation lists before giving the TSS application, the candidate is affected. If the application is submitted after the changes are effective in mid 2018 or in case the TSS application remains pending at the time of the change in the list the candidate is not eligible for getting the TSS.

In the same way, when occupation facing movement to the ROL, before filing the TSS application and the position of a candidate does not exist in a regional area, the candidate is not eligible for getting the TSS.

When the occupation moves between the MLTSSL and the ROL, there will be an effect  on the period of validity of TSS . Moreover, the options for employer sponsored permanent residence will also be affected.

Impact on General Skilled Migration Applicants


After April 2017, applicants whose occupations were removed from the skilled occupation lists before receiving the invitation to apply for the categories in 189, 489, or 190, were not eligible to file an application for any visa. This trend is likely to continue in the future also.

Some applicants whose occupations were moved between MLTSSL and STSOL were affected. This happened because their options became limited or faced better prospects based on the new list. This trend is likely to continue in the future also.

There is a chance that applicants, who got the invitations to apply for a 489, 189, or 190 before the changes but, did not file their visa applications, will remain eligible for the visa category receiving the invitation.

Conclusion


All the aspirants have to note that in case their occupation faces removal, they must file their visa applications as soon as possible.

In case the occupation is likely to move, the aspirants have to keep up to date knowledge regarding the changes. This  may provide an opportunity for applying seeking  a TSS visa, ENS Direct Entry, 489, 189, or 190.
