Canada’s New Pilot Allows to Sponsor Certain Family Members for Canada PR
The latest two-year pilot started on 9 Sept 2019 that will enable sponsorship appeals for specific family members who would usually be banned from receiving Canada PR below the Canadian Immigration & Refugee Protection Regulations.

The pilot cares non-accompanying members of the family who were not examined and in few cases were not even notified when an immigrant national appealed for Canadian PR which usually results in a lifetime prohibition from sponsoring the members of the family in question below paragraphs 125(1)(d) and 117(9)(d) of the regulations.

These regulations demand that global nationals appealing for Canada permanent residence declare all their members of the family like a common-law partner, spouse, dependent children, etc. and have them inspected by an immigration administrator even if they are not accompanying the primary appellant to Canada. Refugees, Immigration, and Citizenship Canada (IRCC) say these laws are in place to support complete disclosure by immigration appellants, to improve the integrity of immigration in the Family Class, and to protect the health, security, and safety of Canadians.

Eligibility Requirements for New Pilot

The pilot will help to immigrate to Canada for the most unsafe populations influenced by the ban who satisfy the below conditions:

  • The foreign national has appealed as a common-law partner or as a spouse in the Common-Law Partner or Spouse in Canada Class or as a common-law partner, spouse, or dependent child beneath the Family Class.

The global national has a sponsor who:

  • Applied for and was awarded PR status as a Convention refugee or an individual in similar cases; or
  • Was awarded Canada PR after being considered a protected person; or
  • Was decided to be a Family Class member and was awarded Canada PR as a sponsored common-law partner, spouse, conjugal partner, or dependent children; or
  • Was decided to be a member of the Common-Law Partner or Spouse in Canada Class and was given Canada PR as a sponsored common-law partner or spouse.

I.R.C.C announced the pilot does not appeal if the sponsor was given permanent residence below Canadian Economic Class or any different immigration category that is not defined in the above requirements.

The pilot will continue in effect from 9 September 2019 to 9 September 2021.
