Canada Overhauls the Criteria for Employers Hiring LMIA-Exempt Foreign Workers

Canada Employers Hiring LMIA-Exempt Foreign Workers
Canada announces that employers willing to recruit LMIA (Labour Market Impact Assessment )-exempt overseas nationals will be required to provide information about their business, including details of employment offer and pay a fee to CIC (Citizenship and Immigration Canada), effective 21 February 2015. 

Beginning 21 February, an overseas national who is exempt from the LMIA process will not be able to get an employer-specific work permit in case his or her employer has not provided the required information and paid the fee prior to the submission of work permit application.

Reportedly, one of the amendments is related to the employers of LMIA exempt overseas nationals who as of now have been able to acquire a work permit at the border of Canada upon providing the details of their academics or training and job to be performed in Canada. Starting from 21 February, employers must seek pre-approval in order to recruit these overseas nationals. The accurate details of the information that must be provided by the employers are not yet revealed. 

Apparently the new system will help Canada to ensure that all the employers whether they are recruiting LMIA-exempt or temporary overseas workers through the LMIA process will face the same level of scrutiny in recruiting international workers. 

Employers of LMIA-exempt foreign workers who do not hold an  open work permit will have to pay employer compliance fee online. On the other hand, employers of foreign workers on open work permits will have to pay fee along with the processing fee of work permit. The fee accrued will be used to pay for new plans to enhance data collection on the role of open work permit holders in the labor market of Canada and to increase the promotional activities to support open work permit holders applying for permanent residence.

International Mobility Program categories that feature open work permits also include common-law partners or spouse of highly qualified overseas workers and foreign students, the working holiday part of International Experience Canada (IEC), the Post-Graduation Work Permit Program and individuals who have received acknowledgement of their application for permanent residence are in possession of bridging open work permits.
