Canada Announces Transitional Measures for Specific Immigration Programs

The Federal Government of Canada has announced that the children over 19 years of age will no longer fall under dependent child category, effective 1 August 2014.

Canadian Citizenship and Immigration Department stated that a child whose age is equal to or above 19 and enrolled into full time studies and relying on their mother/father for financial support will be no longer considered as a dependent child. Nonetheless, the children who depends on their mother/father because of their physical or mental conditions.

Canadian Government’s overhaul to dependents’ children age will help to line up the immigration programs of federal with the Canadian provinces’ age of majority, where the age of majority of provinces is in between 18 to 19 years. 

Applicants who have filed their immigration applications before 1 August 2014 will be processed under the prevailing dependent age-22 or below. On the other hand, applicants who have not yet submitted their immigration applications prior to aforesaid date will be benefited from transitional measures provided by CIC. 

CIC states that the transitional measures allow specific applicants to process their applications depending on the previous  definition for dependents, if they are engaged in multi-step permanent resident programs and not filed their immigration applications as of 1 August 2014. 

The transitional measures will be applicable for those immigration programs which are contrived by the reforms made to the dependent’s child category includes Provincial Nominee Programs, Quebec humanitarian cases, Quebec's economic programs, Parents/grandparents whose sponsorship applications were received prior to 5 November 2011, Live-in caregivers, Privately sponsored refugees whose sponsorship applications were received prior to 18 October 2012, refugees abroad, and refugee claimants.     

CIC stated that the Canadian Government will lock in the age of a dependent child in affected programs based on the initial formal step of immigration process. For instance, the age of a dependent child will be locked in on their application based on the specific date on which the initial contact was made with the province.
