Australia begins labour market testing for key 457 visa occupations

Australian has begun Labour Market Testing (LMT) for its Australian subclass 457 visa programme and more details on how this whole system will work will be given by the Department of Immigration and Border Protection of Australia soon. All visa applications which have be submitted from 23rd November will be subject to the new Labour Market Testing rules of Australia and all those applications submitted before that date will have no affect on them at all. The Australian government believes that it is taking a very sensible step by implementing these new rules as they will require the employers to first test the local market of Australia and only after that they can sponsor an employee on a subclass 457 visa.


The rules though are not as stringent as they were under the previous government, and also there has been no rule imposted still on the amount of time a job must be advertised in the country. Michaelia Cash, who is the Assistant Minister for Immigration and Border Protection said that the labour market testing is a mandatory requirement of the Migration Amendment (Temporary sponsored visas) act 2013 which the last government had introduced and it was also passed by the last government in June. Adequate consultation was not done before implementing anything believes the current government. The subclass 457 visa programme should act as a supplement, and not as a substitute for Australian workers, and the government is very much committed to ensure this. Australian workers have full priority, and the Australian government supports this principle, but the binding of employers in needless red tape will only stymie Australian business and in the long run this will cost Australian jobs a lot stated Cash.

Michaelia Cash stated that the LMT requirement will be exempting highly skilled occupations and employers will be able to advertise through social media and also on their company websites. Any business who is also part of a Labour Agreement will be exempt from this rule. Labour market testing will be applicable to trade and technical jobs which are available for sponsorship under the subclass 457 visa programme. Cash further said that in a small number of cases exemptions will also apply in which labour market testing would also conflict with the international trade obligations of Australia.
