The Australian government published a bill that will assure future subclass 494 and subclass 491 visa holders will have access to several social services of Australia as if they were permanent residents. 

Complete Analysis of the New Bill

In an analysis of the new laws introduced to parliament the Australian government states;

This bill strongly supports the Government of Australia initiatives in maintaining immigration programs of Australia and strengthening regional Australia. As a part of the Package of Population published in the 2019-20 Budget, two latest regional visas are being proposed to support the latest skilled migrants to settle in Australian regional areas.

The current visas will come into force on 16 Nov 2019 and will need holders to work and live in a regional area for a minimum of three years prior to they are suitable for an Australian PR.

The measures in this bill give influence to the policy plan that these skilled provisional regional visa holders have equal access to government services and welfare payments as permanent visa holders. This recognizes that the visas grant a pathway to Australia PR.

These systems also assure that skilled provisional regional visa holders are not disadvantaged related to skilled permanent visa holders available for individuals to work in metropolitan areas.

The new bill guarantees that skilled provisional regional visa holders, which come into force on 16 Nov 2019, to have access to government services and welfare payments as if they are permanent visa holders.

The bill would amend the following legislation:

  • Disability Services Act 1986
  • Social Security Act 1991
  • A New Tax System (Family Assistance) Act 1999
  • Higher Education Support Act 2003
  • Paid Parental Leave Act 2010
  • Fair Entitlements Guarantee Act 2012
  • National Disability Insurance Scheme Act 2013

There are several amendments to these Act’s, and they are focused on giving the subclass 491 and 494 visa holders fair access as if they were Australian permanent residents.
