100,000 H4 Dependent Spouses Received Permission to work in past three Years

Nearly 100,000 H4 dependents who desired to pursue paid job options in the US, during the past three years, face an uncertain future, if there is a change, in the present rules. In 2018, an important case is scheduled for hearing in Washington.

The USCIS latest data shows that the USA had issued documents for authorization of employment to 104,750 H4 visa holders, in the past three years. The beneficiaries were spouses or dependents of H1B workers.

In that period, USCIS has approved job authorization pertaining to 26,858 aspirants in 2015, 41,526 in 2016, and 36,366 for the period ending June 2017.

The data has not calculated the figures pertaining to H4 recipients, who have transformed their position or have exited from the country. An estimate, relying on figures of Green Card and Citizenship, shows that there may not be a sharp variance.

The wave of immigration, in particular to H1B visa workers,    was set in motion,  three decades ago, and has accounts of H4 dependents, who have lost, their prime years of earning a living. Some bear it, and a few return to India or crossover to Canada.

There were no choices for family holders to explore, and the wait was uneasy before President Obama issued the Employment Authorization Documents. Managing a family on a single income is a tough task, in the US.

The reports that some of the visa holders of the H4 category were eligible for work authorization were received with joy. The resistance came, when the issue of economic unrest, was raised by President Trump.

The regulations, allowing the dependents of H1B workers, to pursue work in the US, promulgated by President Obama presently stands challenged in court. It is spearheaded by Save Jobs USA which is an anti-immigration group. The case is pending before the US Court of Appeals and appeals to the sentiments of outrage against outsiders.

US President is pursuing an ambitious policy and goes by decisions which are popular with the fringe crowd. It actually helps his core vote bank. The anti-immigration issue has followed a set pattern since January and the shrill in the tone can be expected as the midterm elections are approaching.

The Trump administration has not contested the lawsuit and is asking for more time and delaying the decision. The recent intervention from the USCIS aims at interpreting the case through the myopic perspective.

Presently the focus on the H1B is intense, and people are waiting for the judgment to be delivered soon.
